These General Terms of Use govern the use of the website worlddepths.com and its subsections (hereinafter the “Portal”). worlddepths.com is operated by FossilWorks, owned by Alejandro Ruiz Saldaña, with registered address at Neuburger Str. 116, 94036 Passau, Germany.

Through the Portal, FossilWorks provides news and updated information on various topics (the “Content”). The Company provides part of this Content in collaboration with affiliated partners. This Content is freely accessible for private use in accordance with these Terms.

worlddepths.com includes interactive features that require user registration (the “Personalized Content”).

Special terms apply to paid services (e.g., Digital Reader, Full Pro Reader), which must be accepted separately. In case of conflict, the special provisions shall prevail.

worlddepths.com and its data providers reserve all copyright and intellectual property rights over the Portal. This includes, without limitation, content, design, layout, and the software used.

The content is strictly for personal use. Full or partial transfer to third parties is prohibited, as well as framing techniques or embedding content via hyperlinks without explicit authorization.

Any modification, removal, or manipulation of copyright notices, trademarks, or any other protected information contained in the Portal is strictly prohibited.

Any commercial use of the content is prohibited unless prior written consent is obtained from the Company.

Linking to the Portal from websites containing offensive, violent, racist, or criminal content is prohibited.

The Company reserves the right to interrupt or restrict access to the Portal at any time, especially regarding free services. For paid services, the cancellation policies of each subscription shall apply.

Disclaimer on User-Generated Content

The Portal may include content published by users (opinions, recommendations, images, etc.). Such content does not represent the official position of the Company and is not pre-reviewed. The Company assumes no responsibility for the accuracy, legality, or reliability of such contributions. Users are strongly advised not to base personal or investment decisions on such content. Please report inappropriate content to info@worlddepths.com for review and potential removal.

“Personalized Content” refers to all services of the Portal that require prior user registration.

To access it, the user must create an account using our centralized login system, providing a valid email address and a personal password.

The Company reserves the right to deny access to Personalized Content if any violation of these Terms and Conditions is detected.

For security and regulatory reasons, access to certain sections may be restricted to users over 18 or those with explicit guardian authorization.

The user is solely responsible for keeping their password secure. The user is fully liable for all actions performed under their account. In case of suspected unauthorized access, the user must immediately notify the Company and change their credentials. The Company disclaims any liability for damages resulting from negligent credential handling.

The user may request account deletion at any time. Upon cancellation, access to Personalized Content will be revoked.

The Company reserves the right to immediately terminate the contractual relationship if the user provides false information, engages in unlawful conduct, harasses third parties, or seriously or repeatedly violates these terms. The Company also reserves the right to verify user identity through official documentation if necessary.

In registered areas of the Portal, users may publish their own content (comments, opinions, etc.), referred to as “User-Generated Content”.

By publishing content, the user grants the Company a free, perpetual, worldwide, non-exclusive right to use, reproduce, translate, edit, distribute, and display such content in any form or media, as well as to sublicense it to third parties.

The user guarantees that they are the author or lawful rights holder of the published content and that it does not infringe third-party rights. The user also agrees to follow security protocols (such as virus scanning of attachments) and protect data integrity.

The publication of illegal content is strictly prohibited, including pornographic, racist, extremist, offensive, or defamatory material. The Company reserves the right to remove such content and take legal action.

The user agrees to indemnify the Company and its providers against any third-party claims arising from their content. The Company may remove content or ban users without prior notice in case of violation.

The user acknowledges that the Portal is indexed by search engines. Therefore, published content, including comments, may be publicly accessible outside worlddepths.com.

The Company reserves the right to use the email address provided by the user during contract execution to send relevant information about similar products and services.

If the user gives explicit consent, the Company will use the provided data to send promotional and marketing communications via email.

The user may withdraw consent or object at any time by emailing info@worlddepths.com or using the unsubscribe link included in each communication. This does not affect access to contracted services.

The Company does not guarantee uninterrupted availability of the Portal and assumes no liability for technical failures, interruptions, or system errors.

The Company is not responsible for unauthorized access to personal data by third parties (e.g., cyberattacks) or for misuse of publicly shared information by users.

Much of the content is provided by third parties. Neither the Company nor its providers guarantee accuracy, completeness, or timeliness, and disclaim all liability unless expressly agreed otherwise.

The presence of advertisements (banners, buttons, microsites) does not imply endorsement by the Company, which assumes no responsibility for their content.

The Portal may include links to third-party websites. The Company does not monitor, control, or assume responsibility for their content or policies.

The Company shall be liable only in cases of intent or gross negligence by its legal representatives, employees, or agents. This limitation applies to contractual breaches, tort claims, and consequential damages, except for essential contractual obligations.

Where liability applies, it shall be limited to foreseeable damages at the time of contract conclusion, with a maximum cap of €3,000 per claim. This limitation does not apply in cases of intentional misconduct or gross negligence by senior management, nor in cases of breach of essential obligations.

The above limitations do not apply to claims arising from injury to life, physical integrity, or health.

These provisions also apply to affiliated companies, data providers, and their respective legal representatives, executives, and assistants.

For commercial users, the place of jurisdiction for any dispute arising from the contractual relationship shall be Passau, Germany. The place of performance is Passau. German law shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

Judicial proceedings are excluded for claims arising from raffles or promotions.

If any provision of these terms is found to be invalid or incomplete, the validity of the remaining provisions shall not be affected. Applicable legal provisions shall replace invalid or missing clauses.

Online Dispute Resolution and Arbitration

The European Commission provides an online dispute resolution platform available at https://ec.europa.eu/consumers/odr/. In accordance with the German Consumer Dispute Resolution Act (VSBG), FossilWorks (Alejandro Ruiz Saldaña) and its affiliates declare that they are neither willing nor obliged to participate in consumer arbitration proceedings.
